Miami-Dade Probate Property

This page is education, not legal advice. It explains who can sell a Miami-Dade property that is in probate, what an estate needs in writing before the property is marketed, and what the dated market evidence means for a personal representative planning a sale.

Key takeaways

  • Often yes, but only once the court has appointed a personal representative and issued letters of administration, and only in the way those letters allow.
  • Typically the letters of administration, the recorded deed history, the association estoppel and current fees for a condominium or homeowners association property, proof that insurance is in force in the estate’s name, and written guidance on homestead status.

Who can sell a Miami-Dade property that is in probate

Until the court appoints a personal representative and issues letters of administration, nobody has authority to sign a listing agreement or a contract for the estate. That appointment happens in the Miami-Dade County probate division, and the attorney handling the estate is the person who tells you what your letters actually authorize.

What the letters say controls the sale. Some personal representatives hold a power of sale under the will and can contract without a further court order; others need court authorization, and some sales close only after the judge approves the contract. A brokerage cannot answer that question for you, and any agent who tells you it does not matter is telling you something expensive.

The sequence that keeps an estate sale from stalling

Estate files fail on paperwork far more often than on price. Before a property is marketed, the estate normally needs the letters of administration, the recorded deed history, the association estoppel and current fees if it is a condominium or a homeowners association property, insurance in force in the estate’s name, and a written answer on whether the homestead exemption and any portability apply after the owner’s death.

Two Florida-specific items catch families out. Homestead property can pass outside the estate to heirs by operation of law, which changes who signs; and property insurance often lapses or is non-renewed on a vacant house, which can end a contract days before closing. Both belong to the estate’s attorney and its insurance agent in writing, before anything is listed.

What the market evidence has to do with an estate decision

Miami-Dade single-family houses are at 5.6 months of supply with 4,445 active listings, and condominiums and townhouses are at 13.2 months with 11,737 active listings. Closed 2026 sales took a median 45 days on market for houses and 68 days for condominiums and townhouses.

For a personal representative those two numbers are a planning tool, not a price. A longer condominium marketing window means an estate holding a unit should budget carrying costs, association fees and insurance for that period, and should expect a buyer’s lender to ask about reserves and milestone inspections. Beneficiaries who are told a single blended county median are being given a number that describes neither property.

The figures on this page are market data, not a price for any one property. When an estate needs a number, Gia Freer, Broker of Record, prepares the written date-of-death opinion of value and the current opinion of value by hand from BeachesMLS data, with the comparable sales attached and the effective date of value stated on the face of each. No automated estimate is published on this site. Estate-tax questions belong to the estate’s attorney and its accountant.

Miami-Dade probate property: questions and answers

Can I sell my parent’s Miami-Dade house before probate is finished?

Often yes, but only once the court has appointed a personal representative and issued letters of administration, and only in the way those letters allow. Some estates can contract directly, others need court authorization or approval of the contract. The attorney handling the estate answers that question; a brokerage cannot.

What documents does an estate need before the property is marketed?

Typically the letters of administration, the recorded deed history, the association estoppel and current fees for a condominium or homeowners association property, proof that insurance is in force in the estate’s name, and written guidance on homestead status. Vacant-property insurance and a lapsed policy are the two items that most often break a closing.

Does PBP Real Estate give legal advice on Florida probate?

No. PBP Real Estate is a licensed Florida brokerage, not a law firm. Appointment, homestead determinations, creditor claims, court authorization and deficiency questions belong to a Florida probate attorney, and tax questions belong to a CPA or enrolled agent.

Does PBP list probate properties in Miami-Dade?

Yes. PBP lists estate property directly in Miami-Dade, Palm Beach and Broward, as a transaction broker working alongside the estate’s attorney; many estates reach us through the attorney handling the case. A licensed PBP agent who handles probate sales in your city works with the personal representative and the estate's attorney from the first call. PBP does not give legal advice.

Will PBP give the estate a date-of-death figure for the property?

Yes, in writing. Gia Freer, Broker of Record, prepares the written date-of-death opinion of value by hand from BeachesMLS data, with the comparable sales attached and the effective date of value stated on its face, and prepares the current opinion of value separately for the pricing decision. No automated estimate is published on this site. If the estate’s CPA requires a formal report from a licensed professional for a federal filing, we will say so rather than substitute our document for it.
